Article 2: Online sales responsibility

Concerning Foolstrip\’s online sales, Foolstrip is responsible for all the products and designs, as well as for the general organisation of the website.

Article 3: Contract implementation

(1) None of the products available on Foolstrip\’s website leads to any sort of forced sale.
(2) Any order implies the customer has fully read and accepted the terms of the sales contract. As soon as the purchase is completd, Foolstrip will send the customer a mail confirmation.

Article 4: Products features

(1) In accordance to the article L. 111-1 of the Consumption Code, the presentation of products on the website displays products main characteristics in order to help the client in his ordering choice.
(3) Foolstrip presents and describes the products available on its website with great accuracy. Foolstrip is not to be held responsible for any possible mistake or change in the product description, and this will not compromise the purchase’s validity. The pictures and drawings illustrating the products are not contractual. Foolstrip cannot be held responsible for any mistake or change concerning the product representation.

Article 5: Delivery / Shipping

(1) Deliveries are possible towards any European country listed on http://www.foolstrip.com/sales/shipping.php
(2) Deliveries are made from Foolstrip\’s premises by selected carriers. The customer is responsible for the shipping cost, which is evaluated according to worth and distance.
(3) Orders are to be delivered within a month at most, but the delivery time is usually much shorter.
(4) If the customer has not received anything within the month following his purchase, he can cancel his order, and consider the contract as revoked.

Article 6: Prices

Final prices indicated on the website are in euros and include all taxes as well as shipping costs, which are determined by the delivery address.

Article 7: Payment

(1) Any purchase is to be completed with a credit card. Foolstrip can choose to restrict its payment methods according to the delivery address, the total amount of the order or any other objective criteria.
(2) The price is given immediately and without any discount.
(3) If the chosen payment method is not possible despite its being in accordance with the contract – whether because the customer cannot pay or that he provided Foolstrip with wrong data, the customer must refund Foolstrip or any legal representative hired by Foolstrip to collect the debt.

(4) Foolstrip is entitled to hire a third party to transfer the payments. If the payment is delayed, Foolstrip can hire a collection agency and therefore forward any personal data in order to proceed to the payment. b) If a third party is hired to collect the debt, the payment will only be considered as completed if the customer pays the total of the due amount.

Article 8: Guarantee

(1) The customer must check the content of is order as soon as delivered, in order to proceed to any claim necessary. (example: missing or broken product, damaged package…)
(2) In case the customer returns the order because of a flaw in the quality, Foolstrip will pay for the shipping.
(3) Products are under the responsibility of Foostrip and its carrier during the shipping. Any claim concerning the product must be mentioned by the customer upon the delivery order together with his signature. Moreover the customer must confirm this claim during the two working days following the delivery, by sending both an email to Foolstrip, at shop@foolstrip.com, and a registered mail explaining the claim to the following address: Foolstrip

Past this delay, any claim will be rejected. In case of a valid claim, the customer may choose a new delivery of his order or a full refund.
(4) If the products delivered do not match the information contained in the email sent by Foolstrip to validate the order, whether in terms of quality or nature, the customer must express his claim within the next two working days. Past this delay, any claim will be rejected. Any claim must be addressed to Foostrip either by sending an email to shop@foolstrip.com or writing a letter to the following address: Foolstrip

In any case, the customer must indicate his bill number, the delivery order number as well as the list of all ordered and/ or received products (both references and quantities). In case there was indeed a mistake in the delivery, the customer may choose a new delivery of his order or a full refund.

Article 9: Responsibility limits

(1) Foostrip is not to be held responsible for any prejudice on life, body or health occurring during the guarantee period. Foolstrip accepts full responsibility for damages caused by itself or its partners (the shipping company for example) whenever they are deliberate or resulting from negligence.
(2) Internet transmission of data does not always prevent mistakes, or accessibility to the website. Consequently, Foolstrip is not responsible for the availability of the website and its online service.

Article 10: Returns policy

(1) the customer is entitled to return the order during 7 days after its delivery, without having to provide any explanation concerning the revocation of his contract with Foolstrip.
(2) Any order delivered must be sent back in a parcel. Products which cannot be returned via mail will be taken back directly from the customer. The return shipping cost is at the expense of the customer if the delivered product matches the order.

Article 11: Data protection

Foolstrip is entitled to save and process any customers\’ data necessary and respecting the law regarding data protection. Foolstrip is also entitled to use and share these data with its filials.

Article 13: Jurisdiction sphere

Both parties agree that the contract is established under French law and that the language of the contract is French. Therefore any litigation falls under the jurisdiction of Paris and more especially the one in charge of the 2Oth district, where is located Foolstrip’s main office, and where the contract was established.

Article 14: Partial nullification

In case one of the contract’s clause is nullified, the rest of the contract remains valid. Nullified clauses are replaced according to the legal procedure. 10-2007 version

Article 15: Changes in terms and conditions

Current terms and conditions can be changed at any time and without notice. Current terms and conditions were updated on October the 30th, 2007.
